Beach Gear Rules in Myrtle Beach: Your Dog's Shade Tent Is Illegal in Summer

The rule nobody warns you about. From Memorial Day to Labor Day the only shade you may carry onto Myrtle Beach sand is a small circular umbrella, in the months a dog needs shade most, and the size limit changes ten minutes up the road.

This is the article nobody writes and everybody needs. Between Memorial Day and Labor Day, the only shade you may legally carry onto a Myrtle Beach beach is a circular umbrella seven and a half feet or less in diameter. Pop-up tents, canopies, cabanas and sun shelters are out, in the exact months a dog most needs shade.

North Myrtle Beach has its own version of the rule, with a different size limit and a different start date. So the same umbrella can be legal in one town and not the other.

That is the headline, and there are seven more gear rules underneath it that decide what you can bring, what you must take home, and what the city may confiscate.

The eight gear rules that affect a dog day

1. The Myrtle Beach shade rule, quoted exactly

From ordinance chapter 5, section 5-4:

"Shading devices, other than circular umbrellas with a diameter of seven and one-half feet or less, shall not be allowed on the beach between Memorial Day through Labor Day."

Read what that permits, not what it prohibits. It permits one thing: a circular umbrella, 7.5 feet or less across. Everything else in the shading-device category is out for the whole of the summer.

Outside that window, the ordinance sets different limits: "Shading devices shall not exceed the maximum size of twelve (12) feet by twelve (12) feet or 144 square feet and the maximum height of any shading device shall not exceed nine (9) feet installed."

So a canopy is legal in April and not in July. The rule tightens for the summer and relaxes again after Labor Day.

Why this matters more with a dog than without one. A person can sit in the sun, get hot and choose to leave. A dog on hot sand under no shade has neither of those options, and heat is the leading avoidable risk on a South Carolina beach. What to do about it. Buy or hire a circular umbrella and check the diameter on the label rather than the box copy. A 7.5-foot umbrella throws a workable patch of shade for a dog if you angle it into the sun rather than straight up, and it can be repositioned through the afternoon as the sun moves. A tent cannot.

2. North Myrtle Beach, a different rule ten minutes up the road

From the city's beach ordinances, the permitted list is "Umbrellas with a center pole no greater than 7 feet, 6 inches" and "circular shade no greater than 9 feet in diameter."

The prohibited list is explicit: "Cabanas," "Pavilions," "Sports-brellas," "Tarps," "Tents."

And the season runs from 15 May to Labor Day, not from Memorial Day.

Put the two towns side by side. Myrtle Beach caps the circular shade at 7.5 feet in diameter. North Myrtle Beach caps it at 9 feet, and separately caps the pole height at 7 feet 6 inches. So there is a size of umbrella that is perfectly legal on North Myrtle Beach sand and too wide for Myrtle Beach sand.

And the seasons start on different dates. Memorial Day in Myrtle Beach, 15 May in North Myrtle Beach. In a year where Memorial Day falls late, there is a stretch where North Myrtle Beach is already restricted and Myrtle Beach is not.

The safe buy: a circular umbrella at or under 7.5 feet in diameter with a pole under 7 feet 6 inches. That is legal in both towns, in every month.

3. Above the high-tide line

Also from section 5-4: "Umbrellas and Shading Devices must be placed above the high-tide line."

Simple to comply with and worth noting, because the instinct with a dog that wants to swim is to set up as close to the water as possible. Set up above the tide line and walk the dog down.

The same section protects lifeguard sightlines. Shading devices must not impede a lifeguard's line of sight, access or egress, and none may be placed within ten feet of an established umbrella line. So the beach service umbrella rows are a boundary, not a suggestion.

4. Nothing stays overnight

Section 5-14 is the one that catches people who plan a two-day setup:

"It shall be unlawful between the hours of 7:00 p.m. and 8:00 a.m. for any person to leave upon, put, place, or set any equipment on the beach including, but not limited to, shading devices, umbrellas, surfboards, floats, life rafts, volleyball nets, etc."

And the consequence: "Any umbrellas, shading devices, obstructions, equipment, or other structures remaining on the beach between the hours of 7:00 p.m. and 8:00 a.m. may be removed from the beach by the governing agency."

So everything comes with you. That includes the crate, the shade, the water bowls, and the mat the dog was lying on. Carry-in, carry-out, every evening.

There is a knock-on for anyone using the evening beach window. In Myrtle Beach the sand reopens to dogs at 5:00 p.m., and equipment has to be off the beach by 7:00 p.m. That leaves you two hours to set anything up and take it down again, which is a good argument for travelling light in the evening: a lead, water, a bowl, bags, and nothing that needs assembling.

5. No glass, and this one is on your side

Section 5-17: "It shall be unlawful for any person to carry or possess any glass, bottle or glassware on the public beaches or public beach accesses."

North Myrtle Beach lists the same prohibition alongside alcohol and fireworks.

A cut paw from glass in sand is one of the most common unplanned vet visits on any beach, and it is invisible until it happens. The ordinance exists because the problem is real, so treat the rule as a benefit rather than an inconvenience. Cans and plastic only, and if you see glass, move the dog away from it.

6. No fires, no grills

Section 5-16 makes it unlawful "to build, start, ignite, or maintain any fire or open flame or use any propane fired grill, cooker, or heating device heated by fire on any public beach, public beach access, street end adjacent to the beach, or any government land immediately adjacent to the beach."

North Myrtle Beach carries the same prohibition.

Note that it covers propane, so the workaround people reach for is also out. This is a picnic beach, not a cookout beach. Which is arguably better with a dog present anyway.

7. No alcohol

Section 5-15 bans possessing or consuming alcohol on any public beach, beach access, street end adjacent to the beach or government land immediately adjacent to the beach. North Myrtle Beach lists the same.

Worth knowing because it changes the character of what an evening beach session looks like, and because a dog owner distracted by an enforcement conversation is a dog owner not watching the dog.

8. Fill in the holes

North Myrtle Beach publishes this plainly: "If you dig a hole on the beach, you must fill it in before leaving."

The city writes it for people digging with spades. It applies to dogs, and dogs dig. A dog that has spent twenty minutes excavating a trench beside your umbrella has created exactly the hazard the rule exists to prevent, and the obligation to fill it in falls on you.

North Myrtle Beach also warns that littering carries fines "up to $1000."

The other rules that shape a dog's beach day

Piers. Section 5-21: "No aquatic activity of any kind may occur within 75 yards of any pier." All year, every pier. If the dog swims, pick a stretch of water with no pier in sight.

Fishing. Surf fishing is legal and regulated in detail rather than banned. The ordinance goes as far as making it unlawful to bait or fish for sharks or other marine animals that may endanger the public within one mile of the beach, and requires fishermen to release such fish "at time of recognition." Practically, that means hooks, line and cut bait on the sand and in the shallows.

Dunes. Section 5-22 makes it unlawful to "destroy, mutilate, break, move, tear up, carry away or alter in any manner the sea oats, beach grass, other beach vegetation, sand fencing." A dog in the dune line is a problem. Keep to the beach and the walkovers.

Bicycles. Prohibited on the public beach from 10:00 a.m. to 5:00 p.m., 1 May through Labor Day, in Myrtle Beach. North Myrtle Beach bans any bike, e-bike or manual, from 15 May to Labor Day between 10 a.m. and 4 p.m. Both windows mirror the dog windows, so in summer you will not meet bikes on the sand during the hours you are there.

Leashes. Seven feet maximum, hand-held, under direct control, in both cities, all year.

The packing list this produces

A circular umbrella, 7.5 feet or less in diameter. Legal in both towns, in every month.

Something for the dog to lie on. Hot sand is a surface problem, and a towel or mat solves it.

Water and a bowl, carried in. There is no assuming a fountain.

Bags, more than you think. The clean-up obligation is explicit in every jurisdiction on this coast.

A hand-held lead under seven feet. Not a long line, not an extended retractable.

No glass, no grill, no alcohol, no tent in summer.

Nothing that has to stay overnight.

Where to stay

A beachfront base makes the gear rules much easier to live with, because you carry everything a short distance and nothing has to survive the night on the sand. That matters most in summer, when the two-hour evening window between the 5:00 p.m. reopening and the 7:00 p.m. equipment deadline is your setup time.

Conclusion

Buy the umbrella, not the tent. Keep it circular and under 7.5 feet in diameter and it is legal on both cities' sand in every month of the year. Set it above the high-tide line, ten feet clear of the beach service umbrella row, and take it home before 7:00 p.m.

Leave the glass, the grill and the alcohol in the car. Fill in whatever the dog digs. Stay 75 yards clear of the piers if there is swimming involved. Keep the lead in your hand and under seven feet.

Frequently asked questions

Can I bring a pop-up tent to the beach in Myrtle Beach?

Not between Memorial Day and Labor Day.
